GRAND RAPIDS, MI (WHTC) - There may be some closure soon involving a fatal plane crash outside of West Michigan Regional Airport three and a half years ago. A preliminary settlement has been filed at US District Court in Grand Rapids that would resolve a wrongful death civil lawsuit against the federal government filed by the family of Emma Biagioni. She was a passenger in a small plane that went down in heavy fog on January 17, 2010. The litigation claimed that negligence on the part of air traffic controllers in Muskegon, who handle the Holland area, led to pilot David Otai losing orientation and crashing the craft. The settlement, which is pending court approval next month, would result in 750 thousand dollars in damages awarded to the Biagioni family, who resides in Illinois. There is no word as to whether any lawsuit has been filed in this matter by Otai’s family, who lives in Kenya.
