DETROIT (WHTC) - The Michigan branch of the American Civil Liberties Union has filed a federal lawsuit against the city of Saugatuck on behalf of two college students who claim that their US Constitutional First Amendment rights were violated. The students contend that the city would not let them perform on public sidewalks, with one of them arrested this past summer. City Manager Kirk Harrier told media outlets that the ordinance allows such performers in city parks with a permit. Harrier also said that the ACLU didn’t make any effort to contact his office before going forward with the litigation and subsequent publicity, while ACLU officials counter that they don’t talk to “targets” unless given permission by the city’s attorney, although they didn’t say if they made any such effort in this case.
